Washington, DC—The Inter-American Commission on Human Rights (IACHR) issued Resolution 71/2025 on October 4, 2025, to grant precautionary measures in favor of Juan Enrique Pérez Sánchez in Cuba, in the belief that he faces a serious, urgent risk of suffering irreparable harm to his rights to life, personal integrity, and health.
According to the request for these precautionary measures, Pérez Sánchez has been deprived of liberty since 2021. He is currently believed to be at risk, because he has a fever and possibly suffers from tuberculosis, among other medical problems that he is not getting care for. Since he was arrested, Pérez Sánchez is said to have repeatedly been subjected to acts of retaliation and punishment for having taken part in protests. In particular, the request for these precautionary measures alleges that the State is not providing the beneficiary with medical care or medication. The State failed to provide information to the IACHR on this issue.
After assessing the legal and factual allegations made by the party who requested these precautionary measures, the IACHR took into consideration the beneficiary’s situation as an individual who is deprived of liberty in this context. The IACHR noted the recent deterioration in his health condition, allegations that he is not getting medical treatment, and the actions of officers of the State who allegedly combine retaliation with a refusal to provide him with timely medical care.
Given these circumstances, the IACHR considers that the beneficiary faces serious, urgent risks. Consequently, in keeping with Article 25 of its Rules of Procedure, the IACHR asked the State of Cuba to take the following action:
The fact that these precautionary measures have been granted and their adoption by the State of Cuba do not entail a prejudgment on a potential petition that may be filed before the inter-American system to allege violations of rights protected by the applicable instruments.
The IACHR is an autonomous body of the Organization of American States (OAS) whose mandate is based on the OAS Charter and the American Convention on Human Rights. Its mission is to promote and defend human rights throughout the Americas and to serve as an advisory body to the OAS in this area. The IACHR consists of seven independent members elected by the OAS General Assembly who serve in a personal capacity and do not represent their countries of origin or residence.
