IACHR Follows Up on Precautionary Measures for Indigenous Families from the Nueva Austria del Sira Community in Peru

Washington, D.C. — On April 10, 2024, the Inter-American Commission on Human Rights (IACHR) adopted Follow-Up Resolution 20/2024 regarding the situation of families from the Nueva Austria del Sira Community in Peru (MC-887-19) after analyzing the information provided by both parties.

In the follow-up resolution, the IACHR analyzed the information provided by the parties; deemed the protection, investigation, and consultation measures taken by the State to be positive; and found that the seriousness of the circumstances and likelihood of irreparable harm constituted a situation of ongoing risk. Likewise, at the request of the State, the IACHR ruled on the scope of the present precautionary measures in relation to issues of legal certainty regarding land ownership, investigations into the events, and other factors.

Consequently, the IACHR decided to:

  1. continue monitoring the precautionary measures granted in favor of the families of the Nueva Austria del Sira community, pursuant to Resolution 57/2019;
  2. request that the State strengthen the protection measures adopted and provide the necessary information in accordance with this resolution;
  3. ask the representative to provide updated information on the situation of vulnerability of the families of the Nueva Austria del Sira community in relation to this resolution;
  4. urge both parties to continue implementing the actions that have been agreed upon with a view to reaching agreements to mitigate the risk factors that have been identified and to protect the families of the Nueva Austria del Sira community;
  5. continue promoting the appropriate follow-up measures pursuant to Article 25.10 and other provisions in its Rules of Procedure.

The precautionary measures in favor of the families of the Nueva Austria del Sira community were granted on November 6, 2019, in view of the risk they were experiencing due to the presence of trespassers who were threatening and attacking them during the recognition and titling of their community land.

The IACHR is a principal and autonomous body of the Organization of American States (OAS), whose mandate stems from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has the mandate to promote the observance and defense of human rights in the region and acts as an advisory body to the OAS on the matter. The IACHR is made up of seven independent members who are elected by the OAS General Assembly in their personal capacity, and do not represent their countries of origin or residence.
