IACHR Reports Implementation of Resolution 2/2020 on Strengthening of the Monitoring of Precautionary Measures in Force

Washington, D.C. - On April 15, 2020, the Inter-American Commission on Human Rights (IACHR) adopted Resolution 2/2020 on the Strengthening of the Monitoring of Precautionary Measures in Force. The resolution seeks to guide monitoring of the implementation of precautionary measures that the IACHR has granted by assessing the actions that states have taken to protect the rights of beneficiaries that are at risk.

The Executive Secretariat appointed a team from the Precautionary and Provisional Measures Section to implement the strategy set out in Resolution 2/20 by periodically reviewing the portfolio of precautionary measures in force. Between April and July 2020, around 100 cases were monitored, the equivalent of approximately 250 communications between parties. The IACHR has also held bilateral meetings and working meetings outside the periods of sessions to further rapprochement between parties and obtain up-to-date information on the implementation of measures that have been granted.

Likewise, a process has been implemented to analyze the precautionary measures that are currently in force with a view to identifying matters that fall under resolution 6 of the document: “propose resolutions to lift the matters that are inactive, that have become moot and in which the Commission no longer identifies the risk factors that call for such measures to remain in force.” The aim of this initiative is to focus the portfolio on issues that require due attention from the IACHR because the regulatory requirements in question remain valid.
Resolutions to lift precautionary measures are substantiated and submitted to the IACHR plenary. Since April, the IACHR has adopted seven resolutions to lift precautionary measures in connection with eight matters concerning the states of Colombia, Ecuador, Guyana, Mexico, Peru, and Venezuela.

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for and to defend human rights in the region and acts as a consultative body to the OAS in this area. The Commission is composed of seven independent members who are elected in an individual capacity by the OAS General Assembly and who do not represent their countries of origin or residence.
